El Diaro de Ibiza reveals today that Amnesia Ibiza has attacked Marco Carola in the Spanish courts for non-compliance with the non-competition clause.
Breach of the non-competition clause
El Diaro de Ibiza report that the DJ has a non-competition clause into his contract signed with Amnesia Ibiza, clause that the club has highlighted in front of Ibiza' court to ask for the ban of Marco Carola' performance at Pacha Ibiza. In the lawsuit, Amnesia requested the precautionary measure to prohibit the performance of the Dj at Pacha, which has been accepted by the judge.
For the plaintiffs, both the promoter of the party and the disc jockey himself would have incurred a "serious breach" of the contract signed with the artist. A representative of Amnesia said that Carola is exposed to a sanction of 2.4 million euros if it acts in Pacha or any other location, given that "this is the penalty that is agreed in the contract itself."
The situation is all the more critical for the Pacha that the resolution establishes the "prohibition to promote any other party or event with the Music On brand and / or its main artist, Marco Carola, either individually or in conjunction with other artists in any other establishment on the island."
However, the uncertainty about the outcome of this lawsuit is total, since yesterday Pacha Ibiza did no comment and had not yet been withdrawn any publicity for the Music On Opening Party planned next 16th of May 2019.
Marco Carola transfer commented around the world
" Music On " parties at Amnesia Ibiza has dominated Ibiza clubbing landscape since their launch in 2012, leading the Friday nights on the island. Marco Carola has created one of the most wanted party on the island so It was obvious that the announcement made at the beginning of the month of his transfer to Pacha Ibiza would be like a bomb well beyond of the white island clubbing landscape commented all around the world.
Amnesia Ibiza will it go to the end by attacking Pacha Ibiza & Marco Carola in front of the court to claimed the 2.4 millions euros or is this just a way for the club to get a big paycheck that would alleviate the huge shortfall of the absence of the most followed evening? Nothing is less sure.
